PIER 52 CIC TERMS & CONDITIONS, AND SAFETY & OPERATING PROCEDURES

BOOKINGS (including online bookings, phone bookings, and bookings made in person)

PAYMENT: All bookings must be paid for in full at the time of making the booking. This applies to all sales channels. No price or booking is confirmed until payment has been made and authorised. 

AUTHORITY: By making a booking you confirm to us that you have the authority to make the booking on behalf of your party and that you accept on behalf of your party that the booking is subject to these Terms and Conditions. A contract exists as soon as payment for your booking is confirmed.

PRICES: All session prices are subject to change. However, once a customer has made a booking the price will not be subject to any change, with exception held for omitted details or invoice errors. To attend a session it must be paid for in full at the time of booking. If a session is booked for multiple people, the full price for all people is due at the time of booking. Any session not paid for will not be valid.

CABLE TIME: All bookings are made on the basis of the cable time shown in the description, i.e. Beginner Sessions provide at least 20 minutes of time on the water, and General Sessions 15 minutes on the water. If other riders agree this time may be split and shared. Any increase in this time for any slot is at the discretion of the Manager and his decision is final.

DISCOUNTS; Any discounts for under 16 and students will be shown during the booking process before payment. Evidence of age and student status must be shown when you check-in. Failure to do so may result in staff requesting payment of the discounted value before allowing you to use the system.

RENTAL EQUIPMENT: Rental wetsuits and wakeboards are available to reserve at the time of booking for a small price. The option to include a wetsuit and/or wakeboard will be shown during the booking process before payment.

CONFIRMATION: Once confirmed you should check the details of your booking carefully and promptly to ensure that it accurately reflects the booking you have requested. You should immediately inform us of any discrepancies or alterations.

CHANGES: Changes to times and dates for confirmed bookings can only be made by phone and up to 24 hours before the booking is due. We will attempt to accommodate any change requests up to 48 hours before the booking, but it may not be possible due to other bookings.

CANCELLATIONS: You may cancel your session at any time; however cancellation within 24 hours before your session start or non-attendance will result in the full loss of your session cost. No refunds will be given for cancellation more than 24 hours before your session, however the monies from your booking will be held as credit on your account within our system for a period of 12 months. We reserve the right, at our own discretion, to reattribute any lost session fees incurred through late cancellation or non-attendance.

GROUPS: Any cancellations of groups of more than 6 participants and retributing costs are purely at Pier 52 management discretion.

CHECK IN:

ARRIVAL: You should arrive at least 30 minutes before the start time of your session to allow for check-in, changing, and any safety briefing (you should also allow 30 minutes after your session ends to shower and change).

LOCATION: Check-in is at reception desk at the Chasewater Innovation Centre, which is also our location address. This is accessed from Pool Lane off the Eastbound A5. There is plenty of parking in the main car parks close to the Innovation Centre.

WALK-UP BOOKINGS: We can accept walk-up bookings if space exists. This cannot be guaranteed, and we strongly recommend pre-booking online or by phone.

CONSENT: All users of the system will be required to sign a waiver form confirming they understand the restrictions, operating procedures, and rules. If customers are under 18, we will require their parent’s/guardian’s consent prior to them using the system. A parental consent form will have to be filled in. No consent form will result in the customer not being able to attend their session – no refund will be given. Once their consent has been given, they can use the System 2.0 without a parent/guardian present for future bookings. All bookings for activities that are age restricted (kids boarding school, youth deal, tuition at the kids rate) require proof of age. If no proof of age can be provided at the time of check-in and there is any doubt about the age, it is at the discretion of staff to decide whether the customer can attend the session or not or will be charged the adult rate. In order to avail of discounted student rates a valid student card is required at check-in. If no student card can be presented, the standard rate will be charged.

RENTAL EQUIPMENT: We have both wet suits and wakeboards available for hire. These should be pre-booked at time of booking, but may be available when you check-in for a small additional charge.

CHANGING FACILITIES: Our changing rooms and showers are currently closed. However we have 3 changing cubicles on the Pier that are sanitised every hour.

OPERATING & SAFETY PROCEDURES:

ACCESS: Both the cables are accessed via the pier on on the southern edge of the water. This is approximately 50 metres from both the Innovation Centre and changing unit.

GUESTS: Guests are more than welcome on the Pier to watch. We ask they don't interfere with the instructor 

USER HEALTH: When participating in a session, customers must be in general good health and must satisfy themselves that the activities are within their abilities. When booking with Pier 52°, customers (if under the age of 18 their parents/guardians) must make a true and accurate declaration of their health and must make Pier 52° aware of any medical conditions they have. Pier 52° reserves the right to refuse a booking on medical grounds  

SAFETY: It must be understood that your participation in the activities available at Pier 52° is your decision and at your risk. The staff at Pier 52° have primary responsibility for the safety of the guests and equipment at all times and their decision is final. If you or any member of your group commits an illegal or potentially dangerous act including carrying or taking of drugs on site, is under the influence of alcohol, persistently disregards the instructions of the session leader or duty manager, or is disruptive or exhibits difficult behaviour, the session leader and duty manager reserve the right to terminate such persons’ participation in the session with no responsibility to them. In such an event there will be no right to any refund and we reserve the right to make a claim for costs and losses incurred.

SAFETY EQUIPMENT: All users are required to wear a life vest and helmet, which are supplied free of charge by Pier 52°.  

MEDICAL ATTENTION: The user will permit for basic First Aid to be administered by a qualified member of staff or by a qualified medical practitioner and in case of a medical emergency for a medical practitioner to provide emergency treatment and/or medication.

UNRULY BEHAVIOUR: Customers are required to be considerate towards others at Pier 52°. If, in Pier 52° reasonable opinion, the customer or any member of their party is behaving or likely to behave in such a way as to cause danger, upset or distress to any third party or damage to property, Pier 52° is entitled without prior notice to expel the customer immediately. No refunds will be made and the customer is liable for any damage caused. The consumption of alcohol or drugs/illegal substances on Pier 52° premises is strictly prohibited and will be prosecuted. Parents/Guardians are liable for their children.

DAMAGE: Should damage or loss to vessels, persons or equipment be caused as a result of wilful damage or gross negligence by a customers, a customer under the influence of alcohol or drugs or as a result of refusal or failure to obey instructions given by our staff, then he or she will be liable for the full amount of repair or replacement and any resulting costs. The course/event leader reserves the right to terminate the course/event. Adults will at all times be responsible for minors in their charge. Our vessels and crew are fully insured.

INSURANCE: Our policy provides full cover for the equipment and cables and third party liability cover for your course/event leader and crew. However we cannot be held responsible for any loss or damage to any person caused other than through our negligence or breach of contract or for damage to your property howsoever caused and we recommend that you take out appropriate insurance cover yourselves for such uninsured losses.

POSTPONEMENT: Pier 52° reserve the right to reschedule or cancel sessions at any time without prior notice, for example due to adverse weather conditions or any circumstance beyond our control. In the event of a cancellation/rescheduling, customers can choose to attend an alternative session or to have their session fee attributed to their account within the booking system. Any rescheduled sessions must be taken within12 months of the date of purchase.

GENERAL:

COMPLAINTS: We have a Duty Manager who is always available to deal with any issues arising from your activity, it is essential you raise any issues during your course/activity so they can be dealt with immediately.

PHOTOGRAPHS: We occasionally take photographs during our sessions, which may appear in our brochures, website and other marketing materials. If a customer does not wish to be photographed this should be raised with Pier 52° in writing before the session commences.

DATA PROTECTION: Personal information requested by Pier 52° is held in its original form and on computer. Pier 52° is the data controller for the purposes of the Data Protection Act 1988 and will process the data in accordance with the act. Pier 52° will not divulge customer information to Third Parties other than the British WaterSki and Wakeboard Federation. By providing us with the information to process a booking, customers agree that their personal information can be held and accessed by our authorised staff and the British WaterSki and Wakeboard Federation and used to contact them in the future by email or text.

INTELLECTUAL PROPERTY: The copyright and all other intellectual property rights in the products and services shown in Pier 52° brochures, website and other materials shall at all times remain the property of Pier 52°

WAIVER: Pier 52° reserve the right to waive any or all of the conditions.

GIFT VOUCHERS:

Pier 52° gift vouchers are valid for 12 months from the date of purchase

UNDERSTANDING OF TERMS AND CONDITIONS: Pier 52°acceptance of any booking will only be done subject to the customer’s acceptance of these conditions. Payment and/or a consent signature of the customer (parent/guardian if under 18 years) will be regarded as evidence of acceptance of and consent to these conditions and to release Pier 52°, its directors, employees, volunteers, agents and sponsors from any liability no matter how arising with their attendance and participation in a session.
